Reporting

In any situation where a student, staff, or faculty member is unsure of whom to contact for assistance regarding concerning behavior, they may contact the OSCCS. Please submit an incident report of alleged misconduct or policy violations involving a student or student organization here. If OSCCS determines that another office is more appropriate to handle the situation, the case may be referred to that office. 

ANONYMITY 

Duke University is committed to maintaining a safe, respectful, and ethical environment for all community members. Reporting concerns enables the University to identify issues, address misconduct, and uphold its values and policies. Students, staff, and faculty are encouraged to report concerns and provide relevant information to ensure a fair and thorough review. 

OSCCS reviews all reports and takes appropriate action as needed, and detailed information supports a thorough review. In most cases, findings and resulting actions remain confidential and cannot be shared with the incident reporter. Although concerns may be reported anonymously, anonymity may limit the actions the University can take. 


Confidentiality 

As part of the University’s commitment to maintaining the privacy, confidentiality, and integrity of student information, OSCCS handles educational records in accordance with applicable federal laws and University policies. Student records are maintained and disclosed only as permitted by law, with careful attention to protecting students' rights while supporting the University's educational mission. The following information outlines the protections afforded to students under the Family Educational Rights and Privacy Act (FERPA). 

FERPA is a federal law governing the release of student education records, including disciplinary records. Accordingly, OSCCS will not disclose student information without the involved student's consent. Duke University complies with FERPA, which (1) allows students to inspect their education records, (2) restricts disclosure of personally identifiable information without prior written consent from a student, and (3) gives students the right to seek corrections to their records 

OSCCS may share student information with University officials who have a legitimate educational interest and a need to know the information in order to perform their institutional duties, as permitted under FERPA. Such officials may include, but are not limited to, personnel from academic affairs, athletics, student affairs, and residence life.
